These Terms of Service (“Terms”) govern your use of ContinuCam, the ContinuCam Wear OS companion experience, the ContinuCam Relay, and related Serevon Labs features or services that link to these Terms. In these Terms, “Serevon Labs,” “we,” “us,” and “our” refer to Serevon Labs, and “you” refers to the person using ContinuCam.
1. Acceptance of these Terms
By downloading, installing, accessing, purchasing through, pairing with, or using ContinuCam, you agree to these Terms. If you do not agree, do not use ContinuCam. If you use ContinuCam on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.
2. Eligibility and lawful use
You may use ContinuCam only if you are legally permitted to do so where you live and where you use the app. You are responsible for complying with all laws and rules that apply to your recordings, including laws concerning video recording, audio recording, privacy, consent, surveillance, confidential information, intellectual property, and use of cameras in restricted locations.
ContinuCam does not determine whether recording a particular person, conversation, place, or event is lawful. You are responsible for obtaining any consent or permission required by applicable law.
3. License to use ContinuCam
Subject to these Terms, Serevon Labs grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use ContinuCam on compatible devices for lawful purposes. Except as permitted by law, you may not copy, distribute, sell, rent, sublicense, reverse engineer, circumvent access controls, interfere with the app or related services, or use ContinuCam to violate the rights of others.
4. Your recordings and other content
You retain ownership of recordings and other content that you create with ContinuCam. You are solely responsible for that content and for how you record, store, export, share, disclose, or otherwise use it.
ContinuCam is designed primarily around on-device recording and storage. Serevon Labs does not claim ownership of your recordings merely because you use ContinuCam.
5. Private vault, encryption, exports, and data loss
ContinuCam may store completed recordings and photos in an app-private encrypted vault protected by keys managed through Android security features. This protection depends on your device, Android, app data, and the continued availability of the relevant encryption keys.
Clearing ContinuCam app data or uninstalling the app can permanently delete private media and/or the encryption keys needed to access it. You are responsible for exporting or otherwise backing up recordings and photos that you need to preserve.
When you export or share media, ContinuCam may create an unencrypted copy outside the encrypted vault or grant another app temporary access to an unencrypted copy. Once media is exported, shared, copied, or received by another app or person, its handling is outside ContinuCam’s encrypted vault and may be governed by that recipient’s policies and your device settings.
6. Recording operation and safety features
ContinuCam includes recording modes and safety features intended to reduce the risk of losing footage, including storage, battery, thermal, finalization, recovery, and segmented-recording protections. These features reduce risk but cannot eliminate it.
No software-based recording system can guarantee uninterrupted recording or successful recovery in every circumstance. Recording may be interrupted or lost because of operating-system behavior, camera or device hardware, storage exhaustion, low battery, overheating, device shutdown, permission changes, network conditions, other apps, file corruption, software defects, or events outside Serevon Labs’ control. For important recordings, monitor the device and maintain appropriate backups.
7. Permissions and background operation
ContinuCam may request permissions and Android foreground-service capabilities needed for features you choose to use, such as camera access, microphone access, notifications, biometric authentication, local-network discovery, storage/export functions, and continued recording or remote readiness while the app is not in the foreground. You can manage supported permissions through Android settings, but disabling required permissions may prevent some features from working.
8. Device pairing and remote control
ContinuCam can pair compatible ContinuCam devices so one device can request recording or camera actions on another device that you have authorized as a recorder. Pairing creates a trusted relationship between those devices. You are responsible for protecting pairing codes, keeping control of paired devices, and removing pairings you no longer authorize.
Remote commands are requests to the recorder. The recorder remains responsible for camera, microphone, recording, encryption, permission, safety, and entitlement checks and may reject a remote command when a requested action is unavailable or unsafe. Network interruptions, device sleep, permission changes, software updates, revoked pairings, or other conditions may delay or prevent remote control.
Removing a pairing is intended to revoke that trusted relationship. Because local and cloud-assisted state can depend on network availability, revocation may require retry or synchronization before every service-side record is fully updated. A removed or revoked pairing does not authorize future access; a new pairing is required to establish a new trusted relationship.
9. ContinuCam Relay
ContinuCam may use the ContinuCam Relay to support authorized pairing and remote control when paired ContinuCam devices are not able to communicate directly over the same local network. The Relay depends on Internet connectivity and third-party cloud infrastructure and may be unavailable, delayed, interrupted, changed, or discontinued.
ContinuCam is designed so paired-device application command and state payloads that travel through the Relay are end-to-end encrypted between paired ContinuCam endpoints. As described in the Privacy Policy, the Relay and its service providers may still process limited authentication, pairing, routing, connection, security, and network metadata needed to operate and protect the service.
The Relay is not a guarantee of continuous remote access. You should not rely on remote connectivity as the sole means of controlling a recording device where immediate control is safety-critical or otherwise essential.
10. Wear OS companion
ContinuCam may provide a Wear OS companion experience that lets a compatible watch request supported camera or recording actions from a paired ContinuCam phone and display limited recording/control state. The phone remains the recording authority and continues to enforce permissions, Premium entitlement, safety checks, and recording rules.
Wear functionality depends on compatible Android/Wear OS devices, Google Play services, connectivity between the phone and watch, and supported platform behavior. Serevon Labs does not guarantee that every watch, phone, operating-system version, or connectivity mode will support every Wear feature.
11. Premium subscriptions and Google Play
ContinuCam may offer optional Premium functionality through subscriptions sold by Google Play. Available plans, pricing, taxes, currency, billing, renewal, cancellation, refunds, payment processing, and eligibility are handled by Google Play under the terms that apply to your Google Play account and region.
Unless Google Play states otherwise, subscriptions may automatically renew until canceled. You can manage or cancel an active Google Play subscription through Google Play. Removing ContinuCam from your device does not necessarily cancel a subscription.
Premium features ordinarily depend on a valid entitlement reported by Google Play. Serevon Labs may also provide limited local access for authorized testing, review, support, or development purposes. Such access does not create or modify a Google Play purchase.
Features included with Free or Premium may change over time. The app and applicable store listing describe the current feature set.
12. Privacy
Our handling of information associated with ContinuCam, device pairing, the ContinuCam Relay, and the Wear OS companion is described in the ContinuCam Privacy Policy. The Privacy Policy is incorporated by reference where applicable.
13. Third-party platforms and services
ContinuCam depends on third-party platforms and components, including Android, Wear OS, Google Play, Google Play services, and cloud infrastructure used to operate the ContinuCam Relay. Exporting or sharing content may also involve third-party apps selected by you. Serevon Labs does not control third-party services and is not responsible for their availability, security, terms, or privacy practices. Your use of those services may be subject to separate terms.
14. Prohibited conduct
You may not use ContinuCam to violate applicable law or another person’s rights; unlawfully record or surveil others; distribute unlawful content; defeat security or access controls for unlawful purposes; obtain unauthorized access to a paired device or the Relay; introduce malicious code; disrupt the app or related services; impersonate Serevon Labs; or misrepresent your authorization to record, control a device, or share content.
15. Intellectual property
ContinuCam, the ContinuCam name and visual assets, Serevon Labs branding, app software, documentation, and other original materials provided by Serevon Labs are owned by Serevon Labs or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you.
16. Updates, changes, and availability
We may update ContinuCam to add, remove, improve, secure, or modify features; address compatibility or legal requirements; or respond to changes in Android, Wear OS, Google Play, devices, cloud services, or third-party components. Some updates may be required for continued operation. We do not guarantee that every feature or service will remain available forever or work on every device, network, operating-system version, or region.
17. Disclaimers
To the fullest extent permitted by applicable law, ContinuCam and related services are provided on an “as is” and “as available” basis. Serevon Labs disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app, recording process, remote-control connection, Relay, Wear companion, or related services will be uninterrupted, error-free, completely secure, or free from data loss.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limited in your jurisdiction.
18. Limitation of liability
To the fullest extent permitted by applicable law, Serevon Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of recordings, photos, data, profits, revenue, business opportunities, goodwill, or anticipated savings arising from or related to ContinuCam or related services.
These limitations do not apply where liability cannot lawfully be excluded or limited, including any mandatory rights available to consumers under applicable law.
19. Your responsibility for claims arising from misuse
To the extent permitted by applicable law, you are responsible for claims, losses, or expenses arising from your unlawful use of ContinuCam, your unlawful recordings or disclosures, unauthorized device control, or your material violation of these Terms. This section does not require a consumer to assume responsibility that cannot legally be imposed under applicable law.
20. Suspension or termination
You may stop using ContinuCam at any time. Serevon Labs may restrict access to features or related services or discontinue them where reasonably necessary for security, legal, platform, abuse-prevention, or operational reasons. Provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and responsibility for prior conduct, will survive as permitted by law.
21. Changes to these Terms
We may revise these Terms from time to time. When we make material changes, we will update the effective date and may provide additional notice where appropriate or required. Your continued use of ContinuCam after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
22. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect to the extent permitted by law. These Terms, together with the ContinuCam Privacy Policy and any additional terms presented for a specific feature or purchase, form the agreement governing your use of ContinuCam.
